Judge dismisses Deliverance Poker lawsuit

The 5th place finisher at the 2010 World Series of Poker Main Event, Mike “The Grinder” Mizrachi, will have one less thing to worry about now as Judge James Nowlin has dismissed the lawsuit filed by Mizrachi’s former sponsor Deliverance Poker without prejudice –which gives Deliverance Poker the option to re-file the lawsuit should new evidence come to light.
The lawsuit stems from a contract between Mizrachi and Deliverance Poker signed sometime in July 2009. According to the court’s findings the contract’s stipulations requiring a certain amount of capital to be raised by August 2009 were never met, meaning Mizrachi was never officially under contract with the online poker website.
The second aspect of the lawsuit was the involvement of Full Tilt Poker in luring Mizrachi away from Deliverance Poker during his deep run in the WSOP Main Event. Judge Nowlin once again dismissed the charges stating that Tiltware doesn’t fall under Texas jurisdiction.
Deliverance Poker made a number of missteps along the way during the hearings, including not supplying the proper documentation and being unable to state with clarity precisely when the contract was signed, not to mention the incredibly odd wording contained in the contract. Because of this things did not look good for Deliverance Poker’s chances in winning the suit after the initial filing that caused quite a buzz in the poker world.
